Sick um Rob, Sick um!

Our Washington Attorney General was the 5th State Attorney General to file a legal claim against the Federal Government for passing the Health Control Bill. Three Cheers for Rob McKenna!

Rob McKenna, a Republican, says he believes the bill "unconstitutionally imposes new requirements on our state and on its citizens" and that the federal mandate requiring all Washingtonians to buy health insurance violates the Commerce Clause and the 10th Amendment.

Gov. Chris Gregoire, a Democrat, said McKenna does not represent her wishes.
"He has, in my opinion, a duty to consult with me," said Gregoire.
She said she might file a counter suit against McKenna. "He obviously does not represent the majority leader or the speaker and he has a duty to consult with them and he has failed.
"He did not call and consult me," said Gregoire, "I don't know who he represents. He does not represent me."

McKenna said he does not need Gregoire's "blessing" to file a lawsuit on behalf of the state.

"My role is to defend the State Constitution and the people of the state," said McKenna, "That includes defending the state from inappropriate actions by the federal government."

McKenna says the 10th Amendment protects states from being forced to follow federal laws that are not covered by the U.S. Constitution.

"That's why the federal government has never imposed an auto insurance mandate, has never imposed a drinking age minimum, has never imposed a motorcycle helmet law," said McKenna.

"There's a reason we have checks and balances in our system of government.

"There's a reason that the constitution of this state provides for a separately elected attorney general."

The Governor needs to be reminded of this!
