The ICE (Immigration) agents who filed this lawsuit against Homeland Security Secretary Janet Napolitano could not have done so without the financial backing of NumbersUSA. To fill you in:  Today, in Dallas' federal district court, the president of the ICE agents union, Chris Crane, and other ICE agents filed a lawsuit against Dept. of Homeland Security Sec. Janet Napolitano and ICE Director John Morton. They are asking the court to block the amnesty decree process in its tracks. The legal work is being done by Kris Kobach, the celebrated immigration litigator who authored Arizona's S.B. 1070.

If you've read Roy Beck's Action Alert earlier today, you already know why the ICE agents feel they must sue to protect themselves. And you know that NumbersUSA is backing the agents because law enforcement officers should not be forced to choose between their oath to uphold the law and keeping their jobs.
The ICE agents' lawsuit is sweeping the media. Fox News Channel has already aired interviews of ICE union president Chris Crane (a plaintiff on the suit) and lead attorney Kris Kobach. Roy Beck just appeared on Fox's "Cavuto" program.
Members of Congress are already issuing statements of support for the agents' lawsuit, including House Judiciary Committee Chairman Lamar Smith, Judge Louis Gohmert, Judge John Carter, Sen. Jeff Sessions, Sen. David Vitter, and Sen. John Boozman.
I think I can already hear a collective sigh of relief across the nation. Most Americans believe that this DREAM directive is unconstitutional. After all, 24 versions the DREAM Act have been introduced in Congress in the last decade, and Congress has never passed the measure. People have been asking us, "Can't somebody sue?" Well, the ICE agents can, and they did -- with our financial backing of them and with your financial backing of us.
Pursuing this lawsuit will be a tremendous financial drain on NumbersUSA. There is nothing in our budget to cover lawsuits. This is the first one we have ever underwritten in our 16-year history. But the DREAM Directive is illegal, and it directly harms our federal law enforcement officers. It must be stopped. We will help, even if it costs us hundreds of thousands of dollars.

  1. 1. Direct Violation of the Law.
    The DREAM Directive orders ICE agents not to put illegal entrants into deportation proceedings, which is a direct violation of the Immigration and Nationality Act.
  2. 2. Unconstitutional Breach.
    The DREAM Directive is an unconstitutional breach of the Executive branch's duty to ensure that the laws are faithfully executed--not systematically set aside.
  3. 3. Abuse of 'Discretion.'
    Instead of giving law enforcement officers the ability to do their jobs, the DREAM Directive ties their hands and prevents the officers from removing illegal aliens.

Without this lawsuit, about two million illegal aliens will be given work permits, allowing them to compete for jobs with the 23 million Americans who cannot find full-time work. Without the financial support of NumbersUSA, the ICE agents would not be able to file this lawsuit.
